Terms of License Guard® by Atlas
✔ First Class Mail is the PRIMARY CONTACT METHOD for License Guard®.
✔ Emails will be sent in the event of returned mail.
✔ Phone calls will be made in the event of returned email.
If phone calls fail, or no response to messages, Atlas’ obligation is fulfilled; no further attempts are made.
✔ License Guard® Guarantee is CONDITIONAL.
Guarantee requires COMPLETE[1] contact info provided and is up to date when notice is sent.
When these conditions are met, Atlas Guarantees to provide notice of upcoming license expiration dates
and / or upcoming Construction Notice deadlines to prevent the loss of part or all of a FCC license.
IF part or all of an FCC license is lost due to Atlas’ failure to provide notice to its client and the client has met the required conditions, Atlas will replace the lost part(s) of the subscribed license in the most exact detail possible based on present FCC rules and regulations.
Atlas guarantees to send notices to the Contact Information we have been given. Should Contact Information change, Atlas does not guarantee tracking down the subscriber's new Contact Information.
✔ License Guard® Client Cancellation
Failing to maintain up to date contact information prevents Atlas from successfully communicating with the client / subscriber and is considered a Client Cancellation of License Guard® services.
Acting on a renewal or construction notice without Atlas involvement, including changing the password and other FCC registration information effectively prevents Atlas from providing services to the affected call sign(s), and is considered a Client Cancellation of License Guard® services.

A Bit of Background on License Guard® by Atlas
In the many years of providing License Guard® services to our customers, the service has had tremendous success in protecting thousands of licenses from accidental expiration and loss of newly filed frequencies, and more, by only asking our subscribers to be sure their contact information is up to date.
Best of all, Atlas backs qualified subscribers using License Guard® services with a Guarantee stating we will replace any subscribed license lost or damaged if our service fails to provide the notification to our subscriber in a timely manner.
**There are exceptions to the frequency / license replacement guarantee!
A few license types, very few, fall outside Atlas' service area.
Atlas may be able to renew these license types; Atlas may be able to replace certain license types; and Atlas can certainly provide the License Guard Notice of Expiration WITHOUT the replacement guarantee.
Atlas will advise prior to subscribing any license whether this is an issue and explain available options.
In the past, we have provided our notices by USPS Certified Mail, backed-up by the subscriber’s provided email address and telephone number. Over time, the cost of using Certified Mail has risen substantially.
While the cost has risen, the pride once taken by postal carriers has declined. The “Green Cards” returned to Atlas, intended to show the delivery date and signature, are blank most of the time and the remainder are mostly illegible or returned as “undeliverable” or “no receptacle” or other miscellaneous excuses for lack of signatures and dates. We have also found Certified Mail is just as ignored as any other type of mail.
For these reasons Atlas has stopped using Certified Mail as a regular contact method.
Our next step was to attempt to reach our subscribers by email. The failure rates on emails tend to be worse than Certified Mail! Mostly invalid email addresses with many ignoring or refusing to reply.
Trying to reach subscribers by phone, typically leads to leaving a message for someone who is not shown on our records as the designated ‘contact person’.
Less than 1% of these phone calls are returned.
Our years of experience have led us to the program we have now, as stated above
in "Terms of License Guard® by Atlas."
