Wondering why you received a
notice from Atlas? At some point in the past, at your request, Atlas
has filed
an application for a new FCC license, or a modification to an existing license,
and you elected to subscribe to our License Guard program to receive the notice
you received! No one receives notices from Atlas unless they have chosen
too. We do not solicit via mail. This subscription was also paid for
at the time of subscription and no money is due for Atlas to file this required
compliance for you. All we need is your signature and verification of our
information on record and we will do the rest!

Technically, it is the
frequencies on a license... line by line... that are subject to being
"Constructed". To the FCC, the term "constructed"
means the frequencies are in use as planned and described on the license they
granted. The notice of construction filed with them is confirmation that
this is true. Therefore, failure to notify them is admission that the
frequencies are not in use and are available to be assigned to other needy
users. When a notice is not filed, the frequencies are placed into a
termination cycle, as we'll describe next. Although in many cases the
frequencies subject to the construction notification comprise the entire
license, it is common for licenses to have some frequencies terminated while
others (that were already on the license when the newer ones were added) are not
subject to termination. So, the license may not be terminated, but recent
modifications to the existing license are at risk.
Once your FCC license is
granted, you must notify the Commission you are operational. This is called a
Notification of Construction and is required of all licensees within a year of
the effective date on the license.
The FCC does send a Construction Notice Reminder. However, if your mailing
address on the license is not correct, you may not receive this notice.
(The FCC does not guarantee you'll be notified. Atlas' License Guard
customers DO have OUR notice guaranteed.) It is very important to keep
your mailing address up to date with the FCC and with Atlas License
Company!
If a Notice of Construction is NOT filed, your license/frequencies will be
placed in a 30-day window of “Termination Pending”. During which a license/frequency
may be reinstated by paying a substantial waiver fee, except for public safety,
filing a late notice of construction along with a letter requesting a waiver of
the rules. Without License Guard, this fee would be the licensee's
responsibility. License Guard customers are very unlikely to encounter
this situation and if they do, Atlas pays the waiver fee.
If the license reaches the end of the 30-day "Termination Pending"
window, and no response is made to the FCC, ALL UNCONSTRUCTED FREQUENCIES WILL
BE TERMINATED. Legally, you must stop using all affected frequencies on the
license until the frequencies can be reinstated by the granting of a new license
application. Quite often, the lost frequencies are not available and
therefore, can be lost altogether. Finding yourself in this position is
highly undesirable since there's going to be expense in obtaining replacement
frequencies and probably expenses in reprogramming equipment as well.

far as the FCC is concerned, the responsibilities connected with being a
licensee are 100% yours. Again, the FCC does not guarantee you'll receive
any type of notice and they will not be sympathetic to your problems if the
filing dates are missed.
